On 10 July 2025, the Parliament of the Republic of Moldova adopted Law no.196/2025 on general product safety, which will enter into force on 11 March 2026.

This law establishes a modern general product safety framework aligned with EU standards, ensuring that only safe products are placed on the Moldovan market.

The law covers all products — including non‑food, non‑cosmetics items and products sold online — requiring safety assessment from design to end use. Key provisions include product design and manufacturing safety, labelling, risk assessment, consumer protection measures, and traceability. Market surveillance authorities are empowered to enforce compliance and take action against unsafe products.

Key Requirements

  • General Safety Requirement: Economic operators may only place products on the market that meet the general safety criteria. Safety assessment must consider design, composition, materials, packaging, intended use, foreseeable misuse, effects from other products, labelling, and cybersecurity or predictive functionalities where relevant.

  • Presumption of Conformity: Products complying with Moldovan standards transposing EU or international standards are presumed safe. Where standards are partially applied, businesses must document which parts were implemented.

  • Manufacturer Obligations: Manufacturers must conduct internal risk assessments, maintain technical documentation for 10 years, label products with identification and contact details, provide instructions in Romanian, and act swiftly if a product is deemed dangerous, including recalls and notifying authorities via SI SRIPP.

  • Authorized Representatives: Manufacturers outside Moldova must appoint an authorized representative responsible for compliance and cooperation with market surveillance authorities.

  • Importers & Distributors: Importers must ensure conformity before placing products on the market, maintain documentation, and report any dangerous products. Distributors must verify compliance, store and transport products safely, and act on detected risks.

  • Distance Selling & Online Marketplaces: Products sold online must include full manufacturer or responsible person details, product identification, and Romanian safety information. Online marketplace providers must implement safety processes, enable consumer reporting, act on dangerous product orders within two business days, and cooperate with authorities for recalls and warnings.

  • Traceability & Record-Keeping: Economic operators must implement systems to track products through the supply chain, record complaints, accidents, and corrective actions, and maintain these records for 5–10 years depending on the type of information.

  • Market Surveillance & Enforcement: Authorities can order removal or recall of dangerous products, issue warnings, and require online marketplaces to block access or display explicit warnings for unsafe products.

Businesses selling products in Moldova should audit all items for compliance with design, materials, intended use, and general safety criteria; update technical documentation, risk assessments, and test reports; ensure labels, instructions, and warnings meet Moldovan requirements in Romanian; implement traceability systems across the supply chain; train staff and suppliers on safety obligations; ensure online and distance sales provide accurate product and manufacturer information with processes for recalls; and continuously monitor guidance, delegated regulations, and enforcement actions from Moldovan authorities via SI SRIPP.
